Le négoce de grains : étude de droit du commerce international

Abstract : Many studies were carried on international sale of goods, on transport of goods and even on maritime sales (i.e. commercial sales involving a maritime transport). However, few of them were based on the type of traffic. Yet, the kind of goods shipped necessarily impacts the analysis of the performance of the parties’ obligations, both with respect to the transport and the international sale of goods. The grain trading study highlights how this type of bulk food affects the chain of both contracts and transactions. Besides, the analysis of the various grain contracts enables on the one hand the understanding of the problems linked to the intervening third-parties (e.g. the role played by the intermediaries when the sales contract is concluded or the issue of the expertise when the goods are delivered). It gives on other hand the opportunity to assess the methods of dispute resolution, whether judicial or arbitral.
