La stipulation pour autrui tacite

Abstract : The tacit "stipulation pour autrui" isn’t expressly present in an agreement. It is found out by a judge in two different operations: the "stipulation pour autrui" can be implicit or presumed. There is some contracts who's nature is to concern three people. They contain usually a "stipulation pour autrui", even if it isn’t expressed. Sometimes, some clauses of the agreement prove the 'stipulation pour autrui", when they can only be executed to a third party's advantage. The judge infers the reality of an implicit "stipulation pour autrui". Sometimes the presence of a "stipulation pour autrui" is very uncertain. The judge, for equity or for juridical logic, presumes the existence of such a "stipulation pour autrui"
