Étude de la qualité d’Etat membre d’organisations internationales : à la recherche d’un modèle d’Etat

Abstract : The reconfiguration of international society from the nineteenth century onwards, and even more so after the First World War, notably through the arrival of international organizations, has meant that states have lost their status as the sole actors in international society. Enjoying legitimacy vis-à-vis states in that they are seen as a means of participation in international relations, certain international organizations use this notoriety to serve as fora through which either a “community of ideology” or a “model state” germinates, or simply combine the two trends. Thus, any state wishing to belong to these organizations, i.e. to be a member and/or to maintain its status, is required to conform to the expectations of the international institution. These expectations include the adoption of the triptych democracy, human rights and the rule of law. In concrete terms, some international organizations make respect for democratic legitimacy a determining criterion for admission to their membership. The State present in such an organization is therefore presumed to be democratic. However, this presumption remains valid as long as the latter respects the conditions on the basis of which it was admitted. Failure to comply with these principles, which are characteristic of these international organizations, results in the loss of membership. Thus, through this policy, these entities set themselves up as a “laboratory” for the transformation of the political system of states. The ultimate aim is to achieve the expansion of a model of governance in public international law, despite the classic principle of the indifference of this law to the internal regime of states.
